The ins co of the guy who hit me called this am and as of right now he has no ins. According to the ins co (State Farm) he has until Nov 1 to pay at least half of his premium for them to enforce coverage for him.
So, please think about the below person driving around without paying when you write out the check for your coverage and be sure to keep him in mind whenever you have to work OT or holidays to pay your ins. Im sure he will think about you while sitting on the couch enjoying a cold one and smiling the whole time since he obviously doesnt have to pay his way.

This is why I like michigan's no fault policy, you have no insurance company to deal with except your own, and they take care of it all.
sorry to hear Myclone, looks like you were very lucky though, as it was only the bed the got most of the damage.
Good luck, is there any way you can pay the premium so you can get it fixed....don't know how Roanoke works....

I thought about that and I may check into it as a last resort rather than take the hit on my ins. IMO I shouldnt have to pay higher premiums on my ins for the next ~5yrs to cover a claim that should be covered by his ins...well if he'd pay his premiums like the rest of us :roll: .
Dunno how that gonna play out and it may be an option depending on what happens. If he's the POS I think he is and unwilling to work something out then its on....

Ok, Ive obviously angered the automotive gods some how....a coworker drove into the back of the dually while pulling into the parking lot at work this AM :roll: .
I know the truck is black...I know it was still dark....but DAMN its the biggest pick up truck they freakin make so how the hell do you not see it? When I get to be 70yrs old and refuse to retire as well as give up my lic someone take them from me so Im not a menace to everyone else on the road :roll: .
Im checking on this Monday.... I got to thinking about what state farm told me about the idiots coverage and that his insurance is in "limbo" unless he pays by Nov 1. I call BS since you either have ins or you dont and I think maybe he is close to not having ins and theyre trying to wait until then so they can tell me to go take a flying leap. Dont think so....Im calling my atourney on Monday and getting his input on this and maybe get him to either make a few phone calls or fire off something on his letter head.

Does the police know he was driving without insurance coverage? If not I think you should enlighten them, at the very least he would get a ticket for that too. I'm sorry, but I think my back, neck or something woulda sent me to the hospital by now, sounds like they(insurance) are going to try to screw ya. You may have to file a civil suit. Good luck!

Basically the guy paid for 6 months worth of ins, got a ins card thats good for a year , but unlike me/the rest of us didnt pay for his last 6 months of coverage.
Word of advice from this same situation happening to me now for the second time.... If you get in an accident and exchange ins info get on your cell phone and call the other drivers ins co right then and there. That way you can inform the cops that the other driver isnt insured or even better put the cop on the phone with the other drivers ins co and let them tell the officer in person. That'll prolly equal the other non ins having dirt bag getting a no ins coverage ticket on the spot....least thats the way I see it.
Yeah the dually got tagged too....by a coworker none the less :roll: . Bent lic plate and scratched roll pan that I can buff out (I think) so no big deal on it.
I'll see what happens this AM when I call the ins co for the final time to straighten out whether he has ins or not. If his check bounced that they say he wrote them and he doesnt have coverage then I'll be at his court appearance that is scheduled for 10AM and see what the judge has to say to him when Im asked if my claim has been settled.
Should know what direction Im going in by this afternoon.......
On paper he has insurance. Dunno about other ppl but most ppl I know that pay their ins every 6mo, including myself, get an ins card that has an expiration date of one year from the coverage beginning date printed on it...not 6 months. Basically if I pay for 6mo of ins Jan 1 Im only covered for 6mo but my ins card has a "expires on" date of Dec 31 which means if I dont pay for the last 6mo in June I have no coverage....but Ive still got a card that says Im covered for another 6mo. Thats what a cop or other motorist gets to see when they are involved in an accident and theres no way to check otherwise. As far as the cop is concerned the guy has valid ins since the card is still good even though its not worth the paper its written on if the premium hasnt been paid. Theres no way to instantly check that, at least in VA, since the ins co, DMV ins info, and the police data bases arent networked. The DMV and police data bases ARE networked as far as your driving record but insurance coverage (or lack there of) arent.NCTyphoon said:

Called State Farm at 8:30am and found that since Mr Payne had been late on his payment he had a lapse in coverage from 10-10-06 to 11-3-06 which means on the day he drove into the side of me (10-13-06) he had no ins coverage.
Mrs myclone and I jump in the vehicle and haul ass to the court house since his court date was at 10am. He gets in front of the judge and pleads guilty to failure to obey a traffic light and causing an accident which the judge fines him $200 for. Judge looks at me and asks if I have been compensated for by his insurance to which I reply no since he had no insurance at the time of the accident. Judge fines him another $500 for unsured motorist and tells mr payne that he should discuss with me how he was going to pay for the damages once he was done paying the clerk his fine. He pays up and is getting ready to walk out when I ask him if he wants to work something out and he hauls ass out the door of the court house.
Welp...I gave him a chance so now I gotta hit him in the ol pocket book I guess. He made the mistake of wearing his work uniform to court (Graham White Inc.) with his name on it :rotf: and I also got his lic number off the car he was driving which was a different car than what he was driving when he hit me. Time for civil court/wage garnish I guess.
(I get the chance there will be an ass kicking too :tup: )

Update FWIW:
After playing phone tag with the adjustor from my ins co for a couple weeks (holidays/work schedule FUBAR'ed things) there will be someone coming out to look things over. So for you guys that Ive contacted about parts hopefully I'll get the ball rolling over the next week or so.
Funny part (IMO) during my conversation with the adjuster over the phone this AM. Goes like this:
Adjuster: "Mr Welch this is Meredith speaking to Mr Welch concerning claim number....blah blah blah.......Mr Welch do you understand that I am recording our coversation and do you agree to be recorded?"
Me: "Yes, recording the conversation is fine with me as I am recording this conversation as well."
Adjuster: "Oh...uh...well...uh...ummm....you are...uh...well....ok.....(long silence).
Me: Grinning like a guy who just played the best practical joke in the world on someone he dislikes at the adjustor stumbling around and stammering trying to come to grips with the fact they arent dealing with your average knuckle head they can treat like a door mat.
Guess you had to be there :lol:

I will have to remember that one. Never thought about it, but I bet it helps a ton if they know they are being recorded they won't back peddle.
You going to have a tape recorder ready when he shows up in person? How about a video camera so we can all watch?

I usually dont tell em theyre being recorded (yes, its perfectly legal in VA) but for some reason I did this time. I couldnt help but laugh a little at the adjustor lady fumbling all over herself trying to figure out what to say since she was just informed that the conversation was being recorded on my end. I guess they arent used to it since when the conversation first started she had a little attitude (no bad just "short" on her end) but once she figured out the entire conversation was being recorded not just the part she wanted recorded Im sure she was trying to quickly recall if she had already said something she wouldnt want anyone else hearing later on. You had to be there I guess....trust me it was funny.

So what are you going to do about the other driver?
Have you found out if he has anything of personal property yet? You know. Because if you bring him to court over this. Thats the first thing they will want to know. If he has another car, odds are they will make him sell it to clear the debt with you.
I'll admit, I've been late on paying insurance for 2 months before due to no job and no funds to cover rent and insurance in the same month. It makes you drive a lot more carefully believe me. And I know if something ever happened I'd be shit out of luck fast. And thank god nothing has/did happen.

I'd force the no license issue to your lawyer if you contacted one already. (Which I'd assume you have.) If he gets caught driving without a license he'll face jail time, a felony charge at that. And seeing you said he works for a place and drives their car. That'll screw him up with his job as well. And make him remember how he ****ed up in the past with this.

Seriously, most ppl prolly think I post this stuff just for my own entertainment purposes but in all honesty I put this stuff out there for other reasons as well (yeah, I wont deny I get a kick out of it too but thats not the point). There will be other ppl in the future who will lock horns with an ins company or any other number of things that may result in their wallet being thinner but if they read between the lines of what I write and the little light bulb comes on in their head with a way to take care of themselves that right there is why I post up my antics and orneryness. There are quite a few young ppl on here that havent been around the block enough to find out that anymore its not if youre gonna get screwed its how bad....personally I prefer to be the screw-er rather than the screw-e when it comes to issues between my blue collar self and a person or corporation that has deep pockets and countless lawyers.
