Unfortunately, going to sue them over the amount you've lost probably won't be worth it. You'll spend money just to get started with a case, let alone carrying it out, and there's the chance they'll weasel out of it. I've seen it happen.

Ridiculous situation, sorry if I ever came across as endorsing them :evil:
They treated me fairly; apparently I was the exception and not the norm.
 
small claims cases only cost 20 bucks to file here...nothing to lose but that - you dont have to retain a lawyer for this - just file, scare em, let em cough up the $. their plane tickets alone would creep up on the amount they owe you, plus hotels, etc etc - or at best for them, they'll retian an attorney in yer area to go to court for them - big $
worst case, you kept someone up at night from stress who likely deserves it!
i oughta mention - i hate attorneys; i hate lawsuits, etc - i'd personally go to near any length to avoid em - but - crappy vendors give my business (and hobby) a bad name - and it sounds like they dont have a leg to stand on, so why not, in this case?

Get your ducks in a row before you do anything.

If you are going to file a small claims lawsuit, get all the reciepts, ALL OF THEM. This may sound like a no brainer, but I've seen people get nothing because of one missing reciept! Second, call a lawyer for a meeting. Most won't charge for a meeting. Tell them exactly what transpired and what would be the best road to take. Even if you have to pay, the advice they give you maybe priceless.

do you live in the same state as these folks? if so do the small claims where you live and let them come and defend themselves. rocks right it's cheap and the restocking stuff probably won't fly.

but i thought if they weren't in your state and didn't do business in your state other than mail order they didn't have to come for a small claims case. you might check that out. if you can take them to small claims thats a no brainer... do it. if they fail to show up they lose and if they don't file an appeal in a short period of time, the verdict stands and maybe you can get something that way. if they do file an appeal then the ball is in their court and they have to prove they didn't screw you and then they start footing the bill.

you might see about getting a lawyer to just write a letter threatening to do something. sometimes that will stir things up a little and a young lawyers letter shouldn't cost too much. don't go to the biggest firm in town.

why dont you give it up, YOU LOST the court case.

Free country, he can do what he likes, if he doesn't believe the decision was just, he can appeal. That's one of the great things about the US.

Go back under your rock, leave that crap outta this thread.

Small claims is an option, but even if you win, it is your responsibilty to collect and follow through...that has gotten you nowhere to this point. And, unless it is in their "legal corporation" documents that you can only file a lawsuit in FLA, you can sue them from anywhere. Moral of the Story, go see and attorney, get good knowledgeable advice. Sue for enough to cover legal fees, lost interest, etc, etc....you won't get everything you ask for, so ask for more than you need. Thats how the US legal system works....just read a personal injury verdict.

Unfortunately, if you want to be honest, this wont kill them off, it will just kill their business in this community, but at least we have all been informed of their business practices..I thank you for that...BTW I have JS suspension, had Dustan, may have bought PEP if it weren't for this situation.

I just got off the phone with Dennis at PEP.

He called me an arrogant asshole and that I should get off the steroids and then hung up on me. I called him back and told him he was a thief and a crook for stealing some of my advance payment for a rear suspension kit that was never built or shipped. He hung up on me agian.

I called him back again and he told me one more call and he was calling the police on me for phone harrassment and hung up on me again.

I called back and left a message alerting him that since PEP had elected to continue it's bad business practices by stealing a portion of my order advance payment, I felt it is my duty to inform the world that I was taken advantage of by PEP. This is NOT attempt to destroy PEP's business reputation. I only want to let my automotive brother's know what had happened to me and to take my situation into account when considering ordering anything from any company that offers products or services similar to PEP.

hmmm... i wonder since you sent him your money and he never sent you anything for it if YOU could call the police on him for theft by deception and refusal to refund your money or provide you with a product?????????

if you bought something on ebay and sent the money and the person never sent you a product thats theft. and if they didn't ever have the product, (as pep didn't have the product to send you, and still don't, even though they said they were gonna ship it out) if that could be considered theft by deception?? that's a criminal offense, and gives you a little leverage to threaten pressing criminal charges??

might be a little far fetched, but maybe not. something to think about.

in a nutshell, they took your money and said it was ready to ship and despite your numerous attempts they have not refunded your money or to this day shipped you anything.

i would say that is theft

what's anyone else think of this idea?

I think everyone that reads this thread should give Dennis a phone call.....sounds like he doesn't like to hear from people. If we think this is wrong we should all call him and tell him what we think.... I know I have free weekends on the cell, so I don't have a problem doing it.
