Here goes, I was talking with Faulkner gm... dealership. called on a 12,000 mile sy they had. they said someone else was buying. then they end up calling me back and say its available, so I start to work up a deal. the truck then lands on ebay which brings it to our forum here. I plan to drive from MI to PA this weekend and to firm things up I put a $500.00 deposit on the car. I'm supposed to leave tommorrow and I call the dealership to find out someone localy came in and left a $1,000.00 deposit. now the salesman says he'll call me at noon tommorrw and let me know? what in the heck happened? and at a dealer? now what?

I'd call and contact the sales manager. Inform him you have a reciept of your downpayment on the truck, and that you could fax it to him, if he doesnt have a copy. And that that reciept is a binding document that you have priority to the purchase of the truck.

How long is your deposit holding the truck for?? most places will give you a certain amount of time to get financing and transporting in order. the more time you need, the more of a deposit they'd LIKE to have. I've had dealerships hold cars for 2 weeks on a $50 downpayment.

I wouldn't let them fumble around just because of the distance.

BTW, i bought my Sy in MI and drove it to PA too. Good Luck

That's a bunch of BS :tdown: . If you made a deposit, you should have a time frame to finalize the deal and any others buyers should be told that the truck is pending sale. And that they can get in line if the deal falls through. Sounds to me like a someone doesn't want to deal with the paperwork since you are out of state...

I wouldnt sweat it. On of my close friends went to see it weeks ago. Its not in the beast of shape. Big ass crack in the dashboard and the paint looks like it was buffed 100 times to make it smooth and shine. It was not kept inside all these years, If it sells for 12,000 id be surprised. Only a not SYTY guy would not see all the flaws. 12,000 miles is nice but not everything. Better luck in your search!!!

this shit almost happened to me.. I traveled 68 miles to look at my sy which was a the dealer for all of half a day. Test drove it and did the paper work. They didn't have a clue what the truck was.. left a $500 deposit and went home. Next day 11ish I get a call from the dealership saying that someone from NY is there willing to pay a few grand more and just put down a $1000 deposit and unless I come get the truck right now (because the new yorkers on his way there as well) then they'll be forced to let the truck go to that guy.

Well I flipped and talked my way out of leaving work early like 15 minutes after I hung up with the dealership.. I get my buddy to run me the 70 miles up there from work... get there and two guys from NY are there filling out paper work. I flipped and told the salesman that his family wouldn't be able to identify him! at this point my buddy started up with the two guys trying to buy the truck out from underneigh me and threatened to sue him since he was a lawyer (he wasn't) which ended up netting me the truck in the end.

I'd def call back and give them hell!

If you really want this truck after you see it in person, then skip the salesman all together and go straight to the Sales Manager / Gm and politley explain that your deposit reciept is dated and that you would prefer to just buy the truck as agreed. If that seems to bounce off.. then pull the fact that you deposit is a legal and binding sale contract as agreed and that there is no cap on the amount of damages that can be awarded for BREACH OF CONTRACT and then mention that all this drama is making you sick and and after all these years you were finally able to find the Sy that was "perfect for you", then run for the rest room to puke (or just do it on his shoes). That should get their attention!

BTW : low miles aint all that and a bag of chips too, I have 21,000 mile 68' Tri-Power Vette that is a complete & total POS!

well guys (and gals?) I've been raked over once again. truck was sold out from under me. I had a check for full amount of the vehicle plus my trade on top of a 500.00 deposit. these people must be straight up stupid. he offered to tack an extra 100.00 on top of my refunded deposit. maybe he knows something I don't know about PA laws? he wanted to send my deposit back as a check and asked for my address. I didn't care to give him that info so I told him I'd call back tommorrow!

personally tell them to at least double it or to discuss the matter further with your attorney. Sorry about the bad luck but hopefully it is just a way to get you the right one for you.

Like I said, they have violated contract law (even in the state of Pa.) and if you let them get away with this then they will continue to screw every one else that graces their doors. It may take some of your time but I bet you $5 that you can easily find an attorney that will jump on this for no retainer.

Please do everyone a favor and sue these assholes! These exact same thing happened to a buddy of mine, he filed BREACH OF CONTRACT and the judge ordered the sale null & void, ordered the current owner to return the truck (an SS 454) to said dealer and dealer to deliver the truck as agreed and to pay damages in the amount of $7,200 plus attorney and court costs. The fella that bought the truck promptly filed suit against the dealer for BREACH OF CONTRACT and BAD FAITH BUSINESS PRACTISES (they sold him a truck that legally belonged to some one else... my buddy!) and was ordered to refund not only the cost of the truck at $8,500 but also the cost of the new wheel / tire package, stereo system and all the other mods he had receiepts for and get this, $15,000 dollars in damages plus attorney & court costs! This was of course appealed by the dealer (and upheld by the state appellate court) but my bud didn't care cause he got his truck and some sweet / expensive mods like the $2,500 Boyd's wheels & tires and jam system!

This dealer offered you $100 extra because he does know somthing..... that he's in DEEP SHIT!

Please, please, please make this dishonest and law breaking "stealership" pay every damn penny you can get so they understand not to screw the next guy..... and file on them with BBS, the state business chamber etc. and plaster their name on every site you can to warn everyone of the truth! They keep doing this and getting away with it because people get pissed, take the $100 and walk away while they made an extra several grand or more. Pretty good trade if it’s your time, trouble and effort that’s wasted for $100 so they can double their profit margin at your expense :2cents:
