Can you go back to them and say that you want to start again? Just get your truck back, get a refund and try and give them back the truck, minus what receipted costs they have?

Your other problem seems to be your own admission that it ran ok when you bought it so they could reasonably argue that you broke it rather than it being damaged?

I'm just playing devil's advocate here. I guess that explains why you need to find out the build details on the engine. Was it sold as stock? Have you still got the ad?

Don't you have some kind of lemon law?

Yeah I know I'm pretty much stuck, I think at this point its just the principal and maybe I'll get lucky...

Have you figured out who did the engine rebuild yet?

AER Manufacturing Part Number RBL4392Z, just found out.

what warranty information you have?

A book stating standard waranty labor guidelines and core return instructions. It also states "warranty is not transferable original owner only" There is absolutely nothing with a name. There is a document hand written with some waranty claim information

what's the VIN number of the Ty?

Got the serial number for the engine? What's the tag say?

I have some numbers at home...

I'm on the phone with AER and they dont think they even make a Typhoon engine. He said there is a 4.3L HO engine but I need to call him back with the engine serial number on monday to find out.

Yeah... If they threw a turbo on anything other than the SyTy specific engine...

Update...

Just spoke with AER Manufacturing and the engine AER# L4392Z is a for a stock 4.3L T-Body non-balanced.

The engine was ordered with the Typhoon Vin number but they sent a Vin Z engine, not for a Typhoon.

Did they mention anything about covering it then? Someone screwed up, and it sounds as if it was the company from which AER ordered the engine.
Worst case may try and see if they will honor a new (CORRECT) motor and offer some type of discount/compensation/cut rate for removal of the incorrect one and installation of the correct?

Yeah I have the contact info for the local sales rep

They actually have a warranty case on this already and they are the ones that sent out a new engine, ordered with my VIN, they screwed up and sent the wrong one.

It's a good start for sure. I haven't been able to talk to anyone who can help at AER but I'm going to bug the shit out of them.

Now I'm in kind of a weird situation. So I bought this truck from a used car dealership and they are the ones who had the engine put in. The shop that did the work(apparently twice with the waranty replacement) didn't have anything to do with ordering the engine. The Customer(used car dealership) supplied the engine.

When I spoke with the AER warranty clerk he told a couple things:

1. The engine was ordered using my Typhoon exact VIN number
2. They dont rebuild an engine specifically for a Typhoon
3. Any turbo or supercharger would void any AER warranty on any AER rebuilt engine
4. Warrantys from AER aren't transferable

I just happened to get lucky and talk to a guy who knew what a Typhoon was apparently the first warranty clerk didn't and sent out a second standard 4.3L. Now I have a feeling that the only way I'm going to get anywhere is if the owner of the used car dealership takes it from here and fights for a refund considering they don't make a low compression engine.

I'll give you guys an update when I know more, keep your fingers crossed.....

Interesting. OK... I still think you should ask an attorney what he/she thinks. Especially one that relates to sales fraud/misrepresentation.

I'm still hopeful for you... however, it's always nice to have a "plan B".

Negotiate with the dealership? Ask for them to remove the incorrect engine, they can handle their own warranty claim and cut you a check for $X amount of dollar refund for a new (CORRECT!) engine?

Excellent idea. You're not asking for the entire amount back, you're just asking to get the engine that it was stated to have and the one that will make the vehicle operable.

"As Is" The thing now is, they advertised as a new engine, it is new but its wrong. The owner continued to brag the entire time I was there showing me all these restoration jobs. His comments were always "I do these thing the right way" He even said he was losing his ass on the Typhoon with all the money he had invested doing it "the right way, new engine, new turbo..."

My fear is that at some point they'll say "Fawk it... it's yours and we don't owe you shit.". You can try and play up the "You do it 'right', so you should want this car to be a good representation of your work". If the guy seems like a car nut (not just milking customers for money), you could ask him if he'd feel comfortable with the purchase if he was the one that bought it.

I hope you're talking to the owner now, and that no salesperson is involved. FWIW: I'm sure they still made money on the deal.

Yeah I've been back and forth with the owner since the transmission started gushing.

Yeah he's a car nut races midgets somewhere around here, monroe I suspect. He's got books of all these cars hes restored mostly 67-72 chev pickups. Thats why he liked my trade. His thing was he had all this work to do the restore the "right way" ended up giving me less than I wanted but at the time I thought the Typhoon good to go right, He does all this work the "right way" LOL

I made that arguement you're suggesting when the trans when tits up. Thats when things started going down hill and my "behavior" according to him became a problem. I just want a fair deal, lifes not fair in love and used car jerk offs, lol

Absolutely, I just got off the phone with a guy from AER, found a guys name on the contact page.

It may or may not lead to anything but he took all the info and was going to talk with the same guy I talked to in the warranty department. I told him they sent the wrong engine, that a Typhoon has a turbo and the engine is built accordingly.

In the event I need to send them a web link to an engine that is a worthy stock replacement any suggestions?
