Got popped for reckless op!

Well, today was not a good day for me and the Sy :(

Let me start off with the story:

About 2 weeks ago I take the truck out for a cruise and i'm just about ready to call it a night, and as i'm close to my house and think to myself "its been a while since I did a launch" So, about 5 houses away, I stop and start to build boost then BAM! I thought for sure my propshaft finally gave out since its a junky stocker. I make it the 3 houses down to my house no problem, park it and call it a day.

Today, (11/10) a friend comes over and we work on his truck for a few hours (Sy-1178) So it got me thinking "hmmm, I should swap out that propshaft quick and take the truck for a spin" Hop underneath there and see the carnage. Propshaft is ok, front diff busted the case!! Looks like where the propshaft bolts to the spline, the case is all broken up.... so at any rate i'm running 2wd and want to do a burnout. So we hop in the truck, go about 10 houses down, turn around so i'm heading home and break them loose. I left about a 100-200 footer and as i'm pulling in the driveway I look in the rearview to see a cop heading my way fast! So I pull the truck in the garage, we get out and stand by his truck as the cop pulls in.

He immediately asks who was driving which I said "Me" then goes on and on about how stupid I am blah blah and starts writing a ticket. Comes back out asking for insurance for the truck and points to Sy-1178. I say I have no idea, I was driving my truck and point in the garage to my truck. He says oh, goes in the cruiser and comes right back with the same ticket. I sign it and he goes on his way.

All the ticket says is "did operate said motor vehicle on a public highway without reguard to the safety of persons and or property"

So my question is now, how can I fight this? He didn't know who was driving and he has the wrong vehicle listed on the citation. I already plan to plea not guilty when I go to court on wed. in hopes of working out a lower charge with the prosecutor but we'll see what happens.

Oh, and here are the marks!;) Sorry they weren't closer pics, but it was the best I could get at the moment.

Heh, at least you didn't do something silly like this:

That was in front of my coworker's house Tuesday after work (you can see his race 'stang out front). His neighbor who claims to have a 750 HP $11K SBC had the throttle get stuck open and struck a utility pole before "parking" it. The cop forgot to sign the ticket so, his lawyer got it throw out . You can try to fight it but depending on the price of the ticket, the time off work and the lawyer fees might not be worth it. That *looks* like a wide open road, didn't you look to make sure that the coast was clear before laying down the rubber?

That's a bummer with the front differential :(. Sounds like a good winter project to me.

Did you guys make any headway with Jesse's old truck? From what I have heard from the owner, it sound's like a handful.

Have an extra diff here so yeah, thats next on the list. Its somewhat running better. He had a bad afpr that we replaced; added the pcv system to the passenger side valve cover, plus we added a little more timing. Seems to be running better, but still has some vacume issues I believe. But hopefully we'll get it figured out.

Re: Got popped for reckless op!

Depending on your record, I'd try the beg for mercy method. Worked for me. In Ca if you get a ticket with a class"A" license traffic school is not an option. Got the ticket reduced to driving without license in possession. 0 points. Still cost $200.00 though. Pssfftt

And pay more attention next time.

Re: Got popped for reckless op!

here in new york the ticket would be thrown out if any info on ticket was wrong. miss spell plate - off, wrong vin - off, miss spelled name - off, go ask a lawyer if you need his help, they should be able to tell you on the phone without meeting them(no pay them).

Thats just it, in my younger years, my record was terrible, but over the last 5-6 years I managed to get it down to 0 points and thats where i'm at now. After talking with quite a few people about this, i'm pretty confident I can get this knocked down either to a 2 pt. peel and squeel ticket, or a non-moving violation. Keeping my fingers crossed!!

Re: Got popped for reckless op!

seriously, i would try to have it thrown out given that the information is missing and or wrong. if thats acceptable he can right write a ticket for say anybody driving something and they get the penalty.

Re: Got popped for reckless op!

i usually use a ticket attorney. their job is to get them thrown out, and with the wrong vehicle on the ticket, it should be very easy. i have paid him $150 before on a 75 dollar ticket, just so it doesnt go on my record.
