i think if you honestly can justify that it is theft by deception with no goods for money paid despite numerous attempts on your part to collect or recieve, you shouldn't call him anymore and the next phone call you make should be to his local police department informing them of whats going on. also the district attorney in his city.

he wants to play hard ball... so play hard ball. i guarantee you the questions they will ask him will go like this.

did he order something from you. answer will be yes

did he pay you for what he ordered, answer will be yes

did you ever tell him it was ready to ship. answer may be yes
no

did he tell you he either wanted his merchandise or his money. answer will be yes;

did you ever ship him his merchandise. answer will be no

did you refund his money. answer will be no.

next question they will ask him will be why not. he can tell you to go screw yourself. but lets see if he wants to try that with them.

i got a question for you barbell? would you still want and accept the merchandise if he agreed to send it? if not you will have to tell them that. maybe you could use the reason for refusing is that so much has gone down you have no faith that what he sent you would be a an acceptable quality.

If I were screwed out of $2000+, you can bet that I would already be in small claims court. Or Judge Judy. :D

Please get a lawyer man! I hate to see people taken advantage of.

now you have some ideas to give that youngish not too expensive lawyer.

something like "please be advised that my client expects to be made completely whole from your company with a complete refund. if this is not done in a reasonable amount of time, we will have no alternative than to litigate this matter in court and seek any punative damages and expenses required in collecting, and will also consider making this a criminal matter based on fraud by deception and theft and will turn this over to your local police department and district attorney to investigate which could invole this case being turned into a felony theft for you.

we hope you chose to refund our money and eliminate the need for harsher pressure being put on you, but my client is tired of waiting and be assured that if we do not have a response to our request within a reasonable amount of time we are completely prepared to act on this matter."

also mention to the attorney that pep has allready offered to refund part of your money. i think that may prove to be important because i think the court would look at it as some kind of admission of guilt even though pep will never admit to it. i mean why would they offer to refund anything if they thought they were blameless.

i think you have enough knowledge on what to you need to do. now find a lawyer that will write you a letter for 50 or 75 bucks and go for it.

Don't think this hasn't been tried.. well sort of.. the problem is Tampa Bay PD doesn't have jurisdiction and it falls into a local sheriff's office.. They don't have an officer who handles internet fraud specifically and in particular after spending half a day between TBPD and this other sheriff's dept back in november the only way the sheriff's dept was willing to assist was if a local officer in vegas/reno area close to adam came out and filled a report officially so they had something on his end to act on.... I'm not sure if adam pursued this avenue with his local PD and the sheriff's dept like I suggested but my impression was that the Florida Attorney Generals office was pretty worthless imo when compared to the help I got from pennslyvania when I had to deal w/ a problem of mine...

The only other alternative might be to get some local tampa people involved in trying to stop by the sheriff's dept or TBPD and get one of their officers to actually get off their duffs and do something because atm the problem isn't adam it's that the police don't seem to be wanting to do their jobs...

that's kind of why i thought if you tried to get the district attorney involved you might get some action. i learned a little trick quite a while back that might work. i you can get someone involved that will turn it over to the right authorities and that these people have to report what actions they took they might not be able to sit back and decide if they want dunkin or krispy donuts.

try the state office of consumer fraud or the attorney general of the state and tell them that you can't get the locals to do anything and see if they will intervene.

bottom line is this is not an easy road to hoe. i'm sorry to see folks get cheated. i wouldn't worry too much about him turning anyone in for harassment. maybe that would be a good thing cause you would get to tell the judge why you were supposedly harassing him. counter sue and ask the judge to hear both cases at the same time.

i'm about exhausted on ideas. it's just a shame that when we deal out of state their are no laws that protect us.

again, i think pep is a really stupid company to garner all this bad publicity over 600 bucks. maybe you should tell him to drop in on our board and see how much love he's gettin. tell him if he agrees to refund in full we will drop it all. otherwise we go to all the other boards and talk about it. remind him of al dunstan.

Well PEP continues to pull it's BS by sending me an invalid check.

The numerical amount area on the check says $1550.00, but the written amount area on the check says One Thousand fifty and 00/100 Dollars.

I'm considering bringing in a lawyer very soon if I don't get my money back.

Just received a prompt return phone call from Tom Emerson at PEP. He has apologized for writing me a check for an incorrect amount and says he's going to stop payment on this check and send me out another check priority mail. At this point I don't know if it will be for my full refund of $2145.00 or if it will be a partial refund.

Btw, Tom was the ONLY guy at PEP who was adult enough to take the time to hear me out. I wanted him to understand that it is very wrong and illegal for PEP to keep even a penny of my advance payment, no matter how much they dislike me or how much I've written to the syty.net crowd about my bad experience with PEP.

I agree with Les, we should all Call PEP just to tell them why we WON'T be spending our money there.
If they start getting more phone calls related to not getting paid then they may start to come around.

Unfortunately someone has to be the stray dog that gets kicked before anyone does anything about it.

Latest update:

Received a replacement check via Priority Mail as promised by PEP.

I received only $1550.00. PEP still owes me $595.00.

I deposited the check today. Will see if it clears or bounces.

In the meantime, does anyone know of other automotive circles that use PEP as a vendor?

*Disclaimer: My intentions are not to discredit PEP or try and discourage folks from buying anything from PEP, rather I only wish to share my horrible experience with others in the automotive community.

if you have the time and inclination i would figure out a way to file a complaint with anyone that will either write him or call him and let him waste his time answering all the people who do. dog his ass and whereever he posts or advertises tell folks how he treated you and tell him to eat shit and die.

kiss the money goodbye and make him sorry he ever screwed you. i still feel that the problem today is most people aren't worried about a good old fashioned ass kicking.

His name is Tom Martino, he's a consumer advocate, and deals with stuff like this on his national radio talk show. Sounds like something right up his alley, they usually harass the hell out of these deadbeat businesses until they cough up the money. The businesses usually get tired of getting calls from the shows listners. As for my opinion of this :fist: PEP !!

Where has sandman been, what a asshole, he was probably in on the deal, try to get kids to spend there money and send deposits, thank god i got all my shit from al fuckstan, he is a total dh, these people just kill them selves in business, the internet is a powerfull tool, where you at sandman, pep is the best, i remember all that bullshit, where you at now ass wipe??????? :fist: :fist:

Rumor mill has it that he bailed on the community and sold his trucks. Good riddance.

I remember all his grand-standing. Where did it get the community? Let us not forget that Sandman was also a proponent of Dequick.
