State Trooper

Quickstop [UK]

Combating adversyty.
I just finished having my alignment and was driving home on I 95 in normal traffic.

I got pulled for doing 75 in a 55 but the notice says "charge 60". The car in front was as fast as me - I honestly thought he was just curious about the car.

I am also looking at $400-600 for no registration after 60 days.

I am so pissed off. Fcuk Delaware. I've been paying $100 insurance for 8 months - why would I dodge an $80 inspection? State Law vs Federal Law is :rainbow:

I love you guys but the USA is sooooo different and there is so much BS and every state is different.

I'm kinda glad to take my car back.

Fcuk today.

Sorry - I am drunk now.

Damn Mark that sucks. I agree that state to state differences in law is lame. I think the law should be the law:tup: Do you have to go to court?

It's a system that actually works pretty well. BELIEVE ME, you don't want the federal goverment "governing" our state highways.

Delaware Troopers are notoriously tough. They are not the kind to pull cars over just to "check out the car," y'know? Sorry for your bad luck situation.

Re: State Trooper

In PA over 5mph you get points on your licence and your insurance in addition to the fine which raises your insurance risk and then the price of your insurance along with that. Not certain in DE how that works, but he actually cut you a break there if it is the same. The killer for you is the no registration. Sorry to hear about your bad luck.

...oh, since you truck topped out at 60mph before....did the alignment allow it to go 75mph??? You have a documented improvement:rotf: J/K

I figured you would talk your way out of the whole thing with your accent. What happened?

Re: State Trooper

can't really blame anyone but yourself for the registration. it's a steep fine...but still, you had to have known it was out. you could try to fight it in court and claim the 'dumb brit' defense. judge might be lenient since it's your first citation.

before you sign the citation as guilty/not guilty call the cop and ask if there's any chance for leniency due to your newbiehood to the states. not knowing the local law is your own fault, but no one in your position would really take the time to read/learn everything. us locals just acquire the understanding through time...so i can fully understand it being annoying when you come across these 'new to you' laws.

Mark, You are pretty lucky it wasn't impounded for no registration. You think it's expensive now...Jim

Re: State Trooper

It's a tough world....just be glad you speak english. When I was in Italy, my Porsche 911 Turbo ran out of fuel 1 km from the Milano exit (where there was a BP station). I thought I could make it but found out when the low fuel light comes on in a Porsche, it means LOW fuel. Nobody was stopping so I secured the car and started afoot for the station to buy a gallon of fuel. When I returned, there was the Carabinieri (Italian state police so to speak) waiting for me....about 4 cars worth of them wanting documentation and answers. The fact I was in the Army didn't set well with a couple of them either.

Speaking little Italian and them snickering amongst themselves while conversing didn't enhance our meeting. Finally, the head dog spoke up....in broken but understandable english. I broke the law.

1) Stopping on the autostrada (like I had a choice).
2) Leaving my Porsche "abandoned" (like I had a choice).
3) Walking on the autostrada (like I had a choice).

As a result, the head dog was sorry to advise me "by law" the car would have to be flat-bedded to the nearest Porsche dealership because fuel cannot be exposed in transfer from a container to a car on the autostrada. You talk about HOT!!! I was but the sad fact was I indeed broke their law, stupid to me as it was and I paid the piper and went on about my business.

Just chalk it up as a lesson learned. I would resister the truck (as should have been done anyway) and plea ignorance in court BUT advise the Judge you quickly rectified the issue when you learned of the violation. Again, since you speak english already, I think it might help your cause.

If it were a case of ignorance then fine, I'd put my hands up. However, I spent hours trying to figure out how the law applies to me. Everything I found said I can drive the car in the US on foreign plates for a max of 1 year. It comes down to residency. Am I a US resident? If you think I would gamble the $1000s invested/wasted on my truck over an ignorance thing then you are mistaken. I can admit being wrong butthe law was so opaque and inconsistent in this area that it would be hard not to be.

You can imagine the assistance I got from DMV in this. Even the clerk of the court had no idea when I called this morning. It's an unconventional scenario. I literally spent hours trying to figure out the law and how it applied to me. I guess my mistake was giving my US license. If I had just given my UK one then there would have been room for me to argue my case with him.

Now I need to go to court on Wednesday morning and plead for leniency or skip the country. I don't want to do that though.

1 week to go and this happens. At least I can show the receipt for the alignment and demonstrate I'm trying to keep it safe and legal.

I was not driving excessively fast. I was consistent with the flow of traffic and actually asked him what proof he had that I was speeding. No photo or video, just his word vs mine despite the traffic being across all 3 lanes and me not overtaking anyone. I could question his ability to discern me from other vehicles but I doubt I'll be doing myself any favors. I actually told him I was only going as fast as the car in front.
I am lucky he didn't impound it or have it towed.

Go to court or skip the country? j/k

I think you have a strong case to get this tossed, especially since you were here temporarily and are leaving in a week. When is your truck going to the Port? Might use that documentation as well to prove your stay was brief. All the best.

"I guess my mistake was giving my US license. If I had just given my UK one then there would have been room for me to argue my case with him."

You were targeted because you had foreign plates on your truck (Perhaps those stickers too )

But you are right, you should have given him your UK license and he would have been confused on what to do and give you a warning.-off you go. But in reality the license is for diving per se -meaning you are license to drive any vehicle whereas the registration is for the particular vehicle.

Half the time cops don't even know those bizarre laws and only looked for the registration sticker and did not see it.

If you have a court date you need to talk to the prosecutor and the cop. The cop will tell the prosecutor it is okay to waive or reduce the summons.

In my opinion they are taking advantage of you because you are out of country. Do not tell them you plan to leave soon or they will definitely try and fleece you knowing you are going out.

If you have the original paper work as to getting the truck over here and the requirements for temp status, show that to the judge if the prosecutor/trooper do not want to reduce the summons. How could you know about registration if no one told you about it?

I got nailed once in the town next to where I live for expired registration and the cop had the car flat bedded then and there. At least you got to drive away, but that fee is f'ing ridiculous

There may be some tips on this site :

Good luck.

Re: State Trooper

Cheers for the goodwill guys.

I had my hearing today and the nice lady State Trooper let me off the no registration issue. She looked at my UK license and siad "oooh. pink, That's cute!" I laughed nervously.

I showed her the UK reg, my license and the DE law where is says foreigners/non residents don't have to get it registered. She waived it there and then!

I still got a minimum $80 fine but apparently no points on my license.

The truck leaves the USA on Friday :)

Phew... I feel a whole lot better now.

The only ticket i've got was dropped because it was left of center Ha. But my cousin got one for doing 80 in a 65 in a not as desirable porsche 944. There was a girl in front of him in the court room that got her over a hundred ticket dropped and was crying hysterically the whole time. So when he went up for his turn the judge looked at him and said its easy to go fast in a porsche huh and wouldn't even reduce it. it almost comes down to luck.

But congats on getting it dropped
